Did you make sure that the Mode is set to RGB not CMYK?

You could also just save it as a PNG when the background is not visible then there's no need to do the background to 40, 40, 40

PNG is not an accepted file type on this forum and it would not allow you to upload it, maybe we should start a pertition to get it listed lol, would make things much easier
